The general role of the tour company is to organize all aspects of the tour including, transportation, scheduling, accommodations and destinations. The company may or may not own the tour bus.

If the tour company owns the bus, they are responsible for providing a vehicle that is safe and that meets all of the federal regulations. In addition, they are required to hire a driver that has a safe driving record. However, if the tour company contracts with a bus company, the tour company is still responsible for hiring a bus company with a good record.

The Bus Company

It is not unusual for the tour company to use a bus company to provide the transportation for their tours.

The bus company has similar responsibilities as those stated above for the tour company if they own the vehicle. The bus needs to be in satisfactory condition and meet all of the licensing requirements.

Different Destinations

At times, destinations will have a contract with specific tour companies to provide a commission or a financial incentive to have the bus stop at their location.

However, if the destination enters into an agreement that the tour bus stops there, they have the responsibility to make sure that the premises is safe for the bus to travel, park and maneuver around the location. If an accident is caused by a hazard at the property, the destination could be held responsible for any damages incurred in the accident.

The Travel Group

The travel group refers to a group of passengers that hire a tour bus or a group of acquaintances who have the desire to travel to the same destinations.

The travel group may be held liable for the accident, if they failed to exercise reasonable diligence in regards to any other party or aspect of the trip, including the tour company, the bus company and the destinations, the travel group can be found responsible for a tour bus accident.
