Do I Need A Car Accident Lawyer?

If you try to handle your car crash claim by yourself, you risk dealing with multiple delays and possibly even denials that can substantially impact your ability to recover compensation as soon as possible. An attorney understands the urgent need for money in some cases and works to provide victims with some relief.

You should certainly report any accident to your own insurance company, but you should avoid speaking to the insurer for any other driver. You will want to make sure you have a lawyer for these types of phone calls.

Insurance company representatives frequently act concerned and express a willingness to help victims, but many phone conversations are actually used to try and get people to make recorded statements that damage their injury claims unknowingly. Some insured may extend settlement offers, but such proposals are usually much less than what victims are entitled to.

Jonathan Perkins Injury Lawyers represents people injured in car accidents in Waterbury and several other communities in Connecticut. We can immediately handle all phone calls from insurance companies and immediately begin negotiating for a fair and full settlement.

It is essential to keep in mind that Connecticut places a statute of limitations of two years on car accident injury claims. Wrongful death actions also need to be filed within two years.

One common concern many people have after a car crash is whether their own actions might prevent them from being able to recover compensation. Connecticut General Statute § 52-572h(b) establishes that in causes of action based on negligence, contributory negligence does not bar recovery in an action by any person to recover damages resulting from personal injury, wrongful death, or damage to property if their negligence was not greater than the combined negligence of the person or persons against whom recovery is sought.

The same statute also provides that the economic or noneconomic damages awarded in a negligence action will be diminished in the proportion of the percentage of negligence attributable to the victim. In other words, a person who is awarded $100,000 in a car accident case but is found to have been 40 percent at fault will have their award reduced by $40,000 and would ultimately receive $60,000.
