Do I Need A Wrongful Death Lawyer?
The first benefit to hiring an attorney is that they will usually conduct an independent investigation of the accident that killed your loved one. This investigation will not only determine the actual cause but will also allow you to know who exactly is responsible.
Another major reason to have a lawyer is because you will usually be contacted by an insurance company representing any negligent party. In most cases, these insurers offer proposed settlements in hopes that you will not file a legal claim.
You should know that these offers are typically much less than what a family might actually be entitled to in these cases. You should also avoid speaking to any insurer simply too avoid the possibility of you inadvertently saying something that ultimately damages your wrongful death claim.
Jonathan Perkins Injury Lawyers can deal with the insurance companies so you don’t have to. Our firm will negotiate a fair and full settlement, and we will not hesitate to file a lawsuit if an insurer refuses to provide satisfactory compensation.

Types of Wrongful Death Cases We Handle
Connecticut General Statute § 52-555 establishes that an executor or administrator can bring an action to recover damages for injuries resulting in death against the party legally at fault for such injuries. If a person dies without making a will designating an executor or administrator, a court will appoint an executor or administrator.
Any person who possesses a will signed by a decedent must deliver it to the appropriate probate court within 30 days of the date of death. When there is no will, an heir or a creditor of the decedent will usually file an application requesting the appointment of an administrator or executor.
A person could be killed in any one of a number of possible accidents. Wrongful death cases may arise from acts of negligence of other parties or deliberate misconduct.
In general, some of the most common causes of wrongful death include, but are not limited to:
- Car Accidents
- Bicycle Accidents
- Defective Products
- Medical Malpractice
- Truck Accidents
- Lead Poisoning
In most wrongful death cases, damages may include awards for medical bills, funeral and burial expenses, and lost earning capacity. In Floyd v. Fruit Industries, Inc. 114 Conn. 659 (1957), the Supreme Court of Connecticut noted that it had consistently held that damages for wrongful death are not restricted to those arising from the mere destruction of earning capacity, as some damages are “recoverable for death itself, even though instantaneous, without regard to earnings or earning capacity.” It is also important to note that Connecticut General Statute § 14-295 provides that in any civil action to recover damages resulting from wrongful death, the trier of fact can award double or treble (triple) damages when it is specifically pleaded that the negligent party deliberately or with reckless disregard operated a motor vehicle and that violation was a substantial factor in causing the victim’s death.
Wrongful Death Statistics

Unintentional injury deaths included 33,381 caused by unintentional falls, 37,757 motor vehicle traffic deaths, and 47,478 involving unintentional poisoning. The CDC reported that there were 30.8 million emergency department visits for unintentional injuries in 2015.
